Terms of Service
These Terms of Service ("Terms") govern your use of the PufAI Telegram bot (@PufAIBot) and the website at pufai.app (together, the "Service"), operated by Erdal Balcı ("we", "us", "our"), an individual sole trader based in Turkey. By using the Service you agree to these Terms.
1. The Service
PufAI is an AI-powered assistant available through Telegram that provides text conversations, AI image generation, and file analysis. The Service is delivered digitally and consumed on a per-credit basis. New users receive 50 free credits on first use.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Service. By using the Service you represent that you meet this requirement and that you have the legal capacity to enter into this agreement.
3. Accounts
The Service is accessed through your Telegram account. You are responsible for the security of your Telegram account and for all activity carried out through the bot from that account. Notify us at [email protected] immediately if you believe your account has been compromised.
4. Credits, Plans, and Payments
- Credits are the internal usage unit of the Service. Costs per action are published on the Pricing page and may be updated with notice.
- Subscription credits (monthly/yearly plans) are granted at the start of each billing period and expire at the end of that period; unused subscription credits do not roll over.
- One-time pack credits do not expire while your account remains active.
- Payments are processed by Paddle.com Market Limited (Paddle), which acts as the Merchant of Record and is responsible for tax collection and remittance where applicable.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time via the Paddle customer portal linked in your purchase confirmation email; cancellation takes effect at the end of the current period.
5. Refunds
Refunds are governed by our Refund Policy, which forms part of these Terms.
6. Acceptable Use
You agree not to use the Service to:
- generate content that is illegal, sexually explicit involving minors, or promotes violence, terrorism, or self-harm;
- infringe intellectual-property rights, publicity rights, or privacy rights of third parties;
- attempt to reverse-engineer, resell, or automate abusive access to the Service;
- circumvent credit limits, quantity caps, referral rules, or other technical restrictions;
- impersonate any person or entity, or use the Service to defraud, harass, or defame others;
- violate applicable law or Telegram’s own Terms of Service.
We may suspend or terminate accounts that violate these rules, and forfeit any unused credits in cases of serious or repeated abuse.
7. AI-Generated Content
Outputs are generated by third-party AI models and may be inaccurate, incomplete, or unsuitable for your purpose. You are responsible for reviewing outputs before relying on them for any decision. The Service is not a substitute for professional advice (legal, medical, financial, or otherwise). To the extent permitted by law, we make no warranties regarding AI outputs.
8. User Content and Ownership
You retain ownership of prompts and files you submit ("Inputs") and, subject to applicable law and third-party model terms, of the outputs generated for you ("Outputs"). You grant us a limited licence to process Inputs solely to operate the Service. We do not use your Inputs or Outputs to train models.
9. Intellectual Property
The PufAI name, logo, bot, website, and underlying software are our property or licensed to us and are protected by intellectual-property laws. Nothing in these Terms transfers those rights to you.
10. Third-Party Services
The Service depends on third parties including Telegram (interface), Paddle (payments), and upstream AI providers (model inference). We are not responsible for outages, changes, or actions of these third parties.
11. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.
12. Limitation of Liability
To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the three (3) months before the event giving rise to liability, or (b) USD 20. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, or data.
13. Indemnity
You agree to indemnify and hold us harmless from any claim, damage, or expense (including reasonable legal fees) arising out of your misuse of the Service, your violation of these Terms, or your violation of any third-party right.
14. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if continued operation becomes commercially or technically impracticable. Sections that by their nature should survive termination (including payments due, disclaimers, limitations of liability, and dispute resolution) will survive.
15. Changes to the Terms
We may update these Terms from time to time. Material changes will be announced through the bot or by updating the “Last updated” date above. Continued use of the Service after changes constitutes acceptance of the updated Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-law rules. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Bodrum, Muğla, Türkiye, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
